1. Who you are contracting with
KidTivity is operated by Junior Streeks, a sole trader trading as KidTivity, of Flat 9 Oak House, 159 Croydon Road, Penge, London SE20 7UB, United Kingdom ("KidTivity", "we", "us"). These terms form the agreement between you and us for your use of the KidTivity app and website (the "Service"). You can reach us at support@kidtivity.co.uk.
2. Acceptance
By creating an account or continuing to use the Service you agree to these terms. If you do not agree, please stop using the Service. You confirm that you are at least 18 years old and, where you are using the Service on behalf of an organisation, that you have authority to bind it.
3. What KidTivity provides
KidTivity lets parents and carers swipe through children's activity ideas, link their account with a partner, see the activities you both liked, and — with a KidTivity Plus membership — use additional filters and access partner discount vouchers. Activity listings, opening times, prices and voucher offers are provided for convenience and may change; we are not the provider of those activities and do not guarantee availability or pricing at any venue.
4. Your account
You must give accurate registration details and keep them up to date. You are responsible for keeping your password confidential and for activity carried out under your account. Linking with a partner shares your swipes, matches and membership status with that person — only link with someone you trust.
5. Acceptable use
You must not:
- use the Service for any unlawful purpose or in breach of any regulation;
- commit fraud, send spam, or impersonate another person;
- infringe the intellectual property or privacy rights of anyone else;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, or scraping our content; or
- reverse engineer the Service, resell or redistribute it, or circumvent technical limits such as swipe limits or membership gating.
6. Intellectual property
We own the Service and all intellectual property in it, including the software, designs, imagery, curated activity content, documentation and the KidTivity brand. We grant you a limited, non-exclusive, non-transferable right to use the Service personally within the plan you have selected. Content you submit (such as your name and postcode) stays yours; you grant us a licence to host and process it solely to run the Service.
7. Service level
We work hard to keep KidTivity running, but we do not guarantee that the Service will be uninterrupted, timely, secure or error-free, and features may change over time. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Payment and subscription terms
KidTivity Plus is a monthly subscription at £4.99 per month, which renews automatically until cancelled. You can cancel at any time from Settings; your membership stays active until the end of the period you have already paid for.
Payments are processed securely by Stripe. We never receive or store your full card details. Please also see our Refund Policy.
9. Seller of record
KidTivity is sold by Junior Streeks, Flat 9 Oak House, 159 Croydon Road, Penge, London SE20 7UB, United Kingdom. Card payments are handled by our payment processor, Stripe. All customer service enquiries are handled by us at support@kidtivity.co.uk.
10. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay for your membership, create a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. You may close your account at any time. When your access ends we will delete or anonymise your personal data as described in our Privacy Notice.
11. Liability
We are not liable for indirect, consequential or special losses, including loss of profits, data or goodwill. Our total liability to you in any 12-month period is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded, including your statutory rights as a consumer.
You agree to indemnify us against claims arising from your unlawful use of the Service or your breach of these terms.
12. General
We may update these terms; material changes will be notified in the app. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a merger, acquisition or sale of the business. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
